Privilege

This section is about the admissibility of certain documents which the claimant wished to include in the Hearing Bundle as evidence, but over which the respondent attempted to assert ‘privilege’. In these circumstances, the Tribunal had to decide whether or not the documents were privileged and, if they were privileged, whether that privilege had been lost or waived, and ultimately whether they were admissible as evidence.
